Privacy and cookie policy

§.1 General provisions – privacy protection principle

  1. The controller of personal data is CA Property Services Sp. z o.o. with its registered office in Warsaw at ul. Hrubieszowska 2, entered in the Register of Businesses under KRS number: 0000317781, Tax Identification Number (NIP): 525-24-38-508, Statistical Number (Regon): 141558187. Data protection complies with the requirements of generally applicable legal regulations and data is stored on secured servers.
  2. CA Property Services Sp. z o.o. as the controller of personal data (hereinafter referred to as the “Controller”) pays great attention to the protection of privacy and confidentiality of personal data entered by Internet users to online forms on the website made available in the www.capspoland.eu domain.

  4. The Controller with due diligence selects and applies appropriate technical and organisational measures ensuring protection of personal data subject to processing. Only individuals duly authorised by the Controller have full access to the databases.
  5. The Controller protects personal data against unauthorised access of third parties, as well as unauthorised processing and violation of the legal regulations in force.

§.2  Grounds for personal data processing

  1. The Controller processes personal data in accordance with the legal regulations, including but not limited to the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (hereinafter referred to as the “GDPR”) for the purpose of:
    1. Responding to inquiries sent with the use of the contact form and by e-mail provided on the website (pursuant to Article 6 clause 1 letter b of the GDPR);
    2. Complying with the legal obligations of the Controller, pursuant to Article 6 clause 1 letter c of the GDPR (e.g. accounting and tax obligations);
  2. Provision of personal data is voluntary. Failure to provide such data will make it impossible to respond to the inquiry sent with the use of the contact form or by e-mail provided on the website www.capspoland.eu.
  3. The user should not provide personal data of third parties to the Controller. However, providing such data they each time declare that they have the relevant consent of third parties to providing data to the Controller.

§.3. Scope of personal data processing

  1. The Controller processes the following scope of data provided by the user in the content of the inquiry made to the Controller.
  2. The data provided by the users is used to respond to inquiries made, including sending commercial information about the Controller and their products and services.
  3. The Controller uses IP addresses collected during internet connections for technical purposes related to server administration. Moreover, the IP addresses are used to collect general, statistical demographic information (e.g. about the region from which the connection comes).

3.a Server logs: The website server saves the user’s IP address in a standard server log. The Controller uses server logs to diagnose server problems, evaluate ca-staff.eu website usage patterns, maintain statistics and improve website functioning. The IP logs do not contain any personal data of the user.

3.b Cookies: The www.capspoland.eu website uses cookies to control content display and monitor website activity. These are small text files sent by the website server and stored by the browser’s computer software. When the browser re-establishes the connection with the website, the website recognises the type of the device from which the connection of the user comes. Parametres enable information included in them to be read only by the server which created them. So, cookies make use of previously visited websites easier.  

  1. The collected information concerns the IP address, type of browser used, language, operating system type, provider of online services, information about time and date, location and information sent to the website via the contact form. The collected data is used to monitor and verify how the user uses the website in order to improve website functioning, ensuring more effective and unproblematic navigation. The Controller monitors user information using the Google Analytics tool which records user website behaviour.

§.4.  Control of personal data subject to processing

  1. The user is obliged to provide data which is complete, up-to-date and correct.
  2. Each user whose personal data is subject to processing by the Controller has the right of access to their data, right to data rectification, erasure, restriction of processing, right to data portability, right to object to data processing based on legitimate interests of the Controller, right to withdraw their consent any time without this affecting the legality of processing (if data is processed based on the consent) carried out on the basis of the consent before its withdrawal.
  3. The rights referred to in the clause above may be exercised by sending an e-mail to contact@capspoland.eu with the relevant request and an indication of the name and surname and e-mail address of the user or by sending a written statement to the address of CA Property Services Sp. z o.o., ul. Hrubieszowska 2,01-209 Warsaw.
  4. The user has the right to file a complaint with the supervisory authority – President of the Personal Data Protection Office, ul. Stawki 2 in Warsaw, in case they consider the processing of their personal data to be in breach of the GDPR provisions.

§.5. Provision of personal data

  1. The data of the users may be made available to entities authorised to receive such data under applicable legal regulations, including competent judicial authorities. Personal data may be provided to entities processing such data on request, namely marketing agencies, entities providing services related to organising trainings, conferences, partners providing technical services (IT system and website development and maintenance).

§.6.  Retention period and other information with regard to data processing

  1. Personal data will be stored only for the period necessary to achieve the specified purpose for which it was sent and after its lapse for a period necessary to secure or assert any potential claims, or comply with the legal obligations of the Controller (e.g. arising from tax or accounting regulations).
  2. If the user consented to their personal data being used in relation to the newsletter service, their personal data will be processed by the time such a consent is withdrawn.

§.7. Right to amend the privacy policy

  1. The Controller reserves the right to amend the privacy policy any time; privacy policy updates will be published on the website in compliance with mandatory legal regulations.

§.8. Acceptance of the privacy policy

  1. By using the www.capspoland.eu website the user accepts this privacy policy.
